As a user of this mobile application, you accept certain risks and responsibilities. You also have the right to know how we protect your privacy and confidentiality and what you should expect from us. Blue Genes, LLC and our third party vendors are responsible for the content, products and services offered in this mobile application.

Please read all our policies and the relevant notices of privacy practices so you know how our mobile application works and how you will interact with it. Please also pay attention to your risks as a user, as users of mobile applications do accept certain risks, such as data collection. It is our goal to protect your personal information from misuse. We may, however, collect data for special reasons, such as research, scientific studies, and statistics.

Please remember that use of this mobile application, its services, programs, and the health information on it cannot replace nor is it intended to serve as a health care provider-patient relationship. You must always consult with a professional for diagnosis and treatment.

We will not intentionally use any personal health information without your permission. We do use non-personal health information which we aggregate for research, scientific studies, and statistics purposes and to improve this mobile application. We also will inform you when your risks or privacy may change during the course of using this mobile application. We may change our privacy policy without prior notice, but will post new changes on the mobile application if/when we do so.

The Blue Genes system operates on a secure server. It is our goal to encrypt your personal information and personal health information before it is transmitted. Encryption is an added security feature designed to help prevent unauthorized persons from seeing your information. Although we make reasonable efforts to protect personal information and personal health information from loss, misuse, or alteration by third parties, you should be aware that there is always some risk involved in transmitting information via the internet and that hackers or thieves do find ways to thwart security systems.

We want your personal information to remain as secure as possible. We use encryption practices to help protect the integrity and privacy of the personal information and/or personal health information you provide to us. As an added security precaution, all personal information and/or personal health information are kept on servers with firewalls that meet or exceed industry standards to prevent intruders from gaining access. Although we make reasonable efforts to protect personal information and personal health information from loss, misuse, or alteration by third parties, you should be aware that there is always some risk involved in transmitting information via the Internet and that hackers or thieves do find ways to thwart security systems.

We reserve the right to change the terms of this privacy policy at any time and will post revisions to our mobile application.

We understand that the personal information and personal health information you provide during your visit to our mobile application is highly sensitive and you may have concerns about sharing such information with us. This information is kept confidential. We do offer special data collection programs that you can "opt-in" to use, in some cases to receive e-mail on health topics or to participate in a new service.

We collect device-specific information (such as your mobile device model, operating system version, unique device identifiers, and mobile network information including phone number). We also may collect and process information about your actual location. We use GPS to determine location and provide content based on your geographical location. We may collect and store information (including personal information) locally on your device using mechanisms such as browser web storage (including HTML 5) and application data caches.

Blue Genes, LLC, independently and through third party partners, collects information in different sections of this mobile application. Blue Genes is interested in your information primarily for the purposes of operating the mobile application more efficiently, providing you with more efficient and reliable functionality, and for answering your questions and concerns.

We collect information about you at several places throughout the mobile application. You will be informed on how this information is collected at that time. In order to have access to many of the services and content available on our mobile application, you may be required to complete a registration form that requests certain information, such as name, date of birth, telephone number and e-mail address. We may offer specialized registration for certain programs, and services that may request some or all of the above information.

We may use your registration information to send you an e-mail confirming your registration with our mobile application or to respond to questions from you. We may also, from time to time, send e-mails, with your permission, on special promotions or newsletters we think may be of interest to you. Once you have opted in, we may send info to you. For example, if you opt-in we may send information regarding your specific health conditions.

We do not intend to use or disclose any personal information or personal health information you provide on our mobile application to an unrelated third party without your express permission, except as explained in this section. We may share aggregate statistical information on our users, sales, traffic patterns and site usage with our business affiliates and sponsors. There is nothing in this information that could be used to identify or contact you. We also may use and/or share your personal health information on an aggregate basis and in an anonymous manner with certain third parties, including your employer or the group health plan with which you are associated. We will use and disclose your personal health information only as permitted by our business associate agreements , as required by law, or where required by the Secretary of Health and Human Services (HHS) to investigate or determine our compliance with the HIPAA Rules.

Vendors and service providers: We may share data with vendors and service providers we hire to help us run our business, including those companies that host, protect, or operate our mobile application; analyze data; provide customer service; provide IT support and services; send emails for us; process payments; conduct surveys; help run promotional activities; or provide marketing, analytics, or advertising services.

Business partners, advertisers, and advertising companies: We may share data with, or make data available to, our partners, advertisers, advertising networks, advertising servers, and analytics companies or other third parties in connection with our and their marketing, promotional, and other offers. These third parties may use your data for their own advertising, analytics, planning, market research, or other business purposes.

Business transfers: As we continue to develop our business, we may sell or purchase assets. If another entity acquires us or all or substantially all of our assets, or assets related to the mobile application, your data may be disclosed to such entity as part of the due diligence process and may be transferred to such entity as one of the transferred assets. Also, if any bankruptcy or reorganization proceeding is brought by or against us, all such data may be considered an asset of ours and as such may be sold or transferred to third parties.

Legal compliance: We may share data with third parties to comply with a legal obligation; when we believe in good faith that the law requires it; at the request of governmental authorities conducting an investigation; to verify or enforce our Terms of Service or other applicable policies; to respond to an emergency; or otherwise, to protect the rights, property, safety, or security of other parties, visitors to our Mobile applications, or the public.

Other disclosures: We may share data for other reasons we may describe to you from time to time as permitted by law.

We want you to be informed about the Third-Party vendors that appear or function as part of this mobile application. To better serve our users, there are parts of our mobile application that are operated by a Third Party ("Affiliated Sites"), as well as links from this site to other sites that are operated by Third Parties ("Linked Sites"). Blue Genes asks that all such third-party organizations, either "Affiliated" or "Linked" sites, disclose their confidentiality practices and procedures and agree to abide by our privacy policy. We make diligent efforts to ensure that third-party vendors are aboveboard; however, we are separate organizations and as such we are not privy to the details of their operations and not responsible for their actions. Blue Genes does not make any representations or warranties regarding the accuracy, integrity or quality of "Linked Sites." Consequently, Blue Genes will not be liable in any way for the Linked Sites, including, without limitation, for any loss or damage of any kind incurred as a result of your use of Linked Sites. You hereby waive any claim against Blue Genes with respect to the Linked Sites. You agree that you must evaluate and bear all risks associated with the use of the Linked Sites, including, without limitation, any reliance on the accuracy, completeness, or usefulness of the material contained in the Linked Sites. Below we provide you with the name of Affiliated Sites represented on our Site and a brief description of the Services they provide to us. We encourage you to read the disclosure statements of any such organization so that you are aware of any differences from their disclosure statements to our own.

You may remove previously provided personal and/or personal health information at any time by contacting us in writing using the address in our Contact Us link.

Users should be aware that it is not always technically possible to remove or delete the information you provide to us. We back-up our systems to protect information from inadvertent loss, and that means a copy of your personal information may exist in a non-erasable form that may be difficult or impossible for us to locate. Nevertheless, upon receiving your request we will try to remove or delete all personal information and/or personal health information stored in the active databases that we use for research and daily business activities. We will not intentionally disclose any personal information stored in a non-erasable format after receiving your request for removal, except as required by law.

Our mobile application offers you the ability to opt in to receive push notifications on your phone. You do not have to opt in to receive these push notifications to use the mobile application. If you do choose to opt in, push notifications may be visible on your mobile device screen even when the device is locked. It may be possible to prevent this by adjusting your device settings. If you choose to opt in to receive push notifications, you should carefully review your device settings to be sure it will display only what you want it to display.

We strive to comply with the Child Online Protection Act (COPA) and are committed to protecting the privacy of children. Although not designed for children, our mobile application may feature information and services of interest to or for children 13 and under. We require parental or legal guardian consent to collect personally identifiable information on any child under the age of 13 in order to be in compliance with COPA, and will employ an age identification mechanism to prevent children under the age of 13 from entering personally identifiable information on the mobile application where personally identifiable information is collected. When consent is given and we collect personally identifiable information on children under 13, we will not disclose this information to any third party. We may, however, use the information to create aggregate data that may be shared with third parties, but there is no way a child can be identified.

CALIFORNIA PRIVACY RIGHTS

If you are a California resident and the processing of personal information about you is subject to the California Consumer Privacy Act (“CCPA”), you have certain rights with respect to that information.

Right to Know. You have a right to request that we disclose to you the personal information we have collected about you. You also have a right to request additional information about our collection, use, disclosure, or sale of such personal information. Note that we have provided much of this information in this Privacy Notice.

Right to Request Deletion. You also have a right to request that we delete personal information under certain circumstances, subject to a number of exceptions.

Right to Opt-Out. The CCPA also provides for a right to opt-out from future “sales” of personal information.

To make a “request to know” or a request to delete, you may contact us as indicated at the bottom of this Notice. To provide or delete specific pieces of personal information we will need to verify your identity to the degree of certainty required by law. We will verify your request by asking you to send it from the email address associated with your account or requiring you to provide information necessary to verify your account. For some types of personal information we may have, such as logs of website usage by unauthenticated visitors, there is no reasonable method by which we can verify your identity as the person to whom that data relates.

You may also designate, in writing or through a power of attorney, an authorized agent to make requests on your behalf to exercise your rights under the CCPA. Before accepting such a request from an agent, we will require the agent to provide proof you have authorized it to act on your behalf, and we may need you to verify your identity directly with us.

Finally, you have a right to receive notice of our practices at or before collection of personal information, and you have a right to not be discriminated against for exercising these rights set out in the CCPA.
